I am on H1 & my H1 (& visa stamping) expires in Apr 2009. My wife has H4 stamped on her passport until Apr 2009.
My wife got her H1 approved in 2008 lottery with permit to start work starting October Ist, 2008.
We are planning to take cruise to Bermuda from sep 28-oct 5. I just wanted to know ,
a) will her H4 stamping be expired on October 5, 2008 , as her H1 will become effective?
b) or she can use existing H4 stamping to re-enter into United States.
c) or if someone knows whether she needs a valid visa stamping in accordance with her latest immigration status (h1 in this case on oct 5 , 2008) when returning to US in cruise.

Your assumption is not right.
Your visa must have a validity date. You can travel out without any problem as long as your travel dates are within that VISA validity date.
No problem if you are not willing to travel..and want to stay in USA. If your H1 is about to expire...then make sure it is extended.

Recently my employer written a mail saying that he is closing the company and said to look for new employer.Previously i am working through a middle layer.When i found new employer he directly approached main vendor regarding contract.Now i am working without middle layer.Mean while middle layer hold my 45 days pay .The middle layer is not willing to pay.It is almost 8 months.I worked more than 20 months through middle layer.Can i get my money back?The middle man Threatening saying there is contract which you cannot go and it is breach.Can you please advise.

Middlesex County Superior Court Judge James Hurley ordered firms that register domains and provide hosting services -- GoDaddy Inc., Network Solutions, Comcast Cable Communications Inc. and DiscountASP.Net, to disable the three sites, ITgrunt.com, Endh1b.com, and Guestworkerfraud.com. Facebook Inc. was also ordered to disable ITgrunt's Facebook page.
The order was made in response to a libel lawsuit filed by IT services and consulting firm Apex Technology Group Inc., based in Edison, N.J. against the three Web sites opposing the H-1B visa program (http://www.h1b.biz/lawyer-attorney-1137085.html). Such attacks on H1B supporters increased last year as the economic situation was gloomy, and prospects for employment were not looking good. Yet, we all know that the H1B program is not the cause of all evil and in fact is a boosting factor in creation of new jobs and opportunities for American workers. My Company applied PERM in Sept'07 at Chicago. Till now company hasn't heard back yet and now employer is planning to file one more PERM appl. through different Lawyer. Can we file one more application without hearing/know the first case status?

From the I-131 instructions document, find the list of docs required:
- I131 application
- copy of 485 receipt
- Copy of Driver's license
- Copy of I94
- Copy of H1 - I797 Approval Notice
- 2 Photos (A# and Name on back side with pencil)
- Check ($305) to U.S. Department of Homeland Security
- Send the application based on where you LIVE
Am i missing anything?

Republican Presidential candidate Newt Gingrich continues to stake out his claim as the sole moderate on immigration in the GOP campaign. Politico reports that he is in favor of a legalization program that will allow "citizen boards" (similar to the draft boards of an earlier era) to determine whether undocumented immigrants deserve to stay in the US. He explicitly rejected a path to legalization. Gingrich is considered a favorite of those in the Tea Party and the candidate's more enlightened positions on immigration support the argument that not all those in the Tea Party are hardliners on immigration.

True up to some extent. When filing AOS, you still "intent" to join for the exact same employment (including location), as specified in your LC. You are NOT required to take that exact employment "at the time" of filing AOS. What is required "at the time of filing AOS" is to have a legitimate intention to take that exact employment upon GC. By joining for that exact employment from anytime now, will actually help in proving the "legitimacy" of your intention (but not "required").
My LC and I-140 was approved with my ex-employer in CA.Now I have a oppurtunity to join my ex-employer in the east coast. Will I be able to file AOS if I join in a similar role and when my PD becomes current ? The immigration lawyer of my ex-employer told me that I have to join in the same location as my LC was approved to take advantage of AOS as it is location specific. Is it true?

If I understand correctly, once the I-140 is approved, the PD is fixed. Make sure you have all the details of your privious I-140.
you can take up new FT and once the new I-140 is approved and if EB2 July is current at that time, you can ask USCIS to apply that PD to your new I-140. Also the new I-140 needs to be with same or similar job duties / description.
